Abstract

Nella transizione che ci sta portando verso un’«economia dei dati», continuiamo a cercare un plesso di principi giuridici coerenti che possano guidarci verso una definizione chiara e operativamente gestibile dei diritti di accesso e trasferimento dei dati. A livello di policy, i legislatori europei sembrano decisi a stabilire un quadro giuridico che non si accontenta di individuare e correggere eventuali fallimenti di mercato, bensì tende a coniugare la creazione di opportunità – tramite regolamentazione ex ante – per l’innovazione, basata sull’uso dei dati, ed il controllo, ex post, delle dinamiche concorrenziali. L’ascesa delle piattaforme digitali e le preoccupazioni per l’impatto che potrebbero avere sulle dinamiche concorrenziali hanno tuttavia determinato un climax in cui la coesistenza di diverse normative potrebbe portare a soluzioni applicative frammentate e divergenti. A ricordare l’esigenza di un avanzamento cauto rispetto a rimedi sempre più severi e che potrebbero incidere significativamente sulle scelte di business e di investimento delle imprese
