The Antitrust (Residual) Regulation of U.S. Labor Markets

Abstract

Negli ultimi decenni studi empirici hanno messo in luce svariati problemi legati alla (non) concorrenzialità dei mercati del lavoro. Il saggio analizza le ragioni che suggeriscono di affrontare il problema della concorrenzialità dei mercati del lavoro, spostando il focus dal lato dell’offerta a quello della domanda (di lavoro), nonché le ragioni della possibile chiamata in causa dei rimedi antitrust. I casi e gli esempi trattati suggeriscono che, nella perdurante assenza, inefficacia o inadeguatezza di altri strumenti regolativi, le autorità antitrust statunitensi hanno iniziato a svolgere un ruolo di regolazione residuale nei mercati del lavoro, al fine di promuoverne una maggiore concorrenzialità ed arginare alcune condotte anticoncorrenziali delle imprese.
