Maritime Concessions and Circularity Defects: Looking for a (New) Right of First Refusal

Abstract

Il contributo analizza criticamente gli ultimi interventi legislativi assunti dal Governo Draghi e dall’Esecutivo in carica, a seguito dei pronunciamenti dell’Adunanza Plenaria del Consiglio di Stato. Inoltre, vengono illustrate le disposizioni contenute nella l. n. 218/2022 (Legge annuale per il mercato e la concorrenza 2021), nonché quelle della l. n. 14/2023, di conversione del «Decreto Milleproroghe», nella prospettiva di procedere verso il riordino e la semplificazione delle disposizioni in tema di concessioni demaniali marittime. Su tale disciplina, caratterizzata da diffusi tratti di illegalità e che ha comportato l’avvio di una seconda procedura di infrazione per l’Italia, sono oramai intervenuti tutti i poteri dello Stato e i più diversi organi giurisdizionali. È la volta buona?.
