The Fba Amazon Case between Tying Conduct and Self-Preferencing (I Wish I Could but I Can’t!)

Abstract

Con un articolato provvedimento l’Agcm partecipa al dibattito, ancora aperto, intorno alla configurabilità del self-preferencing quale autonoma fattispecie di abuso da sfruttamento (con effetti escludenti). Sotto la lente dell’Autorità italiana è finita la condotta di leveraging messa in atto da Amazon che, facendo leva sulla «ultra-dominanza» detenuta nel mercato a monte dei servizi di intermediazione su marketplace, avrebbe indebitamente favorito il proprio servizio accessorio di logistica offerto sul mercato a valle. Tra le pagine del provvedimento – che certo risente dell’esperienza di Google Search (Shopping) e del fermento regolatorio eurounitario – si annida tuttavia più di una questione lasciata irrisolta: fra tutte, l’indefinito rapporto del self-preferencing con la rassicurante categoria delle pratiche leganti; i confini incerti della definizione di una condotta che sia contraria alla concorrenza sui meriti; un’apertura, nei fatti, ad una «quasi-essential facility doctrine» che, come si evince chiaramente dagli obblighi di neutralità imposti alla società di Bezos, avvicina le infrastrutture digitali a modelli di pubblica utilità.
