The Italian Antitrust Authority’s Fine on Poste Italiane for Abuse of Economic Dependence: The First Step towards «Back to Future»?

Abstract

Poste Italiane è stata sanzionata dall’Agcm per circa 11 milioni di euro per abuso di dipendenza economica. Nella ricostruzione dell’Autorità, la sua condotta avrebbe determinato oneri eccessivi e ingiustificati a discapito di Soluzioni S.r.l. ed avrebbe quindi ostacolato l’affermazione sul mercato di un potenziale concorrente. Dopo anni di silenzio, il procedimento in commento ha riportato prepotentemente in auge una fattispecie, quella dell’abuso di dipendenza economica, che pareva esser caduta nell’ombra. Il più ampio revirement della dipendenza economica sia dal punto di vista dell’enforcement dell’Agcm sia legislativo – con le recenti modifiche apportate dalla legge annuale per il mercato e la concorrenza entrate in vigore di recente – sembrano quindi suggerire un potenziale ruolo della fattispecie nella transizione dei poteri dell’Agcm «dall’analogico al digitale».
