An Attempted Murder of Italian Competition Law? The Timing of Antitrust Proceedings in the Strict Interpretation of Italian Administrative Judges

Abstract

In questo articolo si esaminano alcune questioni derivanti dall’applicazione delle norme sul procedimento sanzionatorio amministrativo alle indagini dell’Autorità garante in materia di intese ed abusi, ai sensi degli articoli 101 e 102 del Trattato. Tali norme, che riguardano i tempi del procedimento, nella fase preistruttoria e istruttoria, nonché la prescrizione, per come scritte e talvolta interpretate dai nostri giudici amministrativi si sono rilevate inadatte e tali da violare il principio di effettività di stampo eurounitario, in contrasto con l’art. 4, paragrafo 3, del Trattato dell’Unione Europea. Il rischio, già verificatosi e sempre più forte in prospettiva, è che molte intese ed abusi che violano la concorrenza e determinano gravi danni ai mercati rimangano sostanzialmente impunite. Sulla scorta di questa conclusione, in assenza di un (auspicabile) intervento del legislatore volto a introdurre una disciplina ad hoc dei tempi del procedimento, capace di bilanciare i diritti di difesa e il principio del giusto procedimento con il canone di effettività, quantomeno l’interpretazione delle norme esistenti dovrebbe modificarsi e svolgersi in coerenza con i principi del diritto della concorrenza europeo
