The General Court’s Renvoi Judgment Closing the Loop Within the Intel Saga. What’s Next For The As-Efficient-Competitor Test?

Abstract

La sentenza di rinvio del Tribunale dell’Unione europea nel caso Intel, con l’annullamento integrale della sanzione miliardaria che essa aveva irrogato a Intel ben tredici anni fa, sembra aver inflitto un duro colpo all’operato della Commissione europea. E riporta così in auge uno dei principali interrogativi del dibattito in materia antitrust: quale ruolo va riconosciuto all’analisi economica nella valutazione degli effetti di una condotta potenzialmente abusiva, quale peso può continuare ad avere il test del concorrente altrettanto efficiente e, soprattutto, quale standard probatorio è richiesto alla Commissione europea? La pronuncia non manca di offrire numerosi spunti di riflessione non solo da usare come chiave di lettura per altre pronunce attese nei prossimi mesi e che si interrogheranno sui medesimi principi, ma anche per le imprese, in ottica di self assessment delle proprie condotte.
