Public Procurement and Bid Rigging: Corruption, Cartels, and Organized Crime in the Decisions of the Italian Supreme Court

Abstract

Il presente contributo studia i fenomeni distorsivi riguardanti la «turbata libertà degli incanti» (art. 353 c.p.), partendo dalle 617 pronunce delle Sezioni giurisdizionali della Corte di Cassazione tra il 2016 e il 2020. Quali cause principali delle turbative emergono la corruzione, i cartelli e altre condotte quali minaccia, violenza, false documentazioni o dichiarazioni. L’analisi porta alla luce alcuni elementi distintivi del fenomeno, come la natura e frequenza dell’illecito, la sua distribuzione geografica, il ruolo dei soggetti coinvolti, le caratteristiche della gara, l’utilità percepita nei casi di corruzione e la modalità di segnalazione dell’illecito. Il quadro che emerge evidenzia l’esigenza di favorire la massima collaborazione tra autorità coinvolte, stazioni appaltanti e Consip, nonché la necessità di rafforzare i presidi anticorruzione e la tutela della concorrenza nei procedimenti di aggiudicazione dei contratti pubblici
