Big G and the French Dispute on Online Contents – Interim Measures, Not Antitrust Unicorns (Anymore)!

Abstract

L’utilizzo delle misure cautelari, che parevano esser destinate a fare sporadiche apparizioni nel panorama antitrust europeo, sta tornando prepotentemente alla ribalta. Recentemente è stata la volta della Francia, dove la Corte d’appello di Parigi ha ritenuto che la nuova policy di Big G sulla visualizzazione degli snippet potesse costituire una condizione commerciale non equa e discriminatoria tale da poter arrecare un pregiudizio grave ed immediato all’intero settore. Il caso in commento fornisce dunque l’occasione per riflettere non solo sull’approccio interventista abbracciato da alcune autorità antitrust e corti nazionali nei mercati digitali, ma anche su come le misure cautelari potrebbero risultare uno strumento di enforcement vincente particolarmente in quegli ambiti in cui non si assiste a problematiche antitrust del tutto nuove o sconosciute, ma i cui gli effetti negativi per le dinamiche concorrenziali potrebbero moltiplicarsi e materializzarsi molto più velocemente e brutalmente.
