European Legislation on the Protection of Whistleblowers Also Introduces New Obligations for Companies

Abstract

The deadline for the implementation of the EU Directive on the protection of whistleblowers expired on 17 December 2021. Whistleblowers are people who, in the course of their work, encounter irregularities that can harm the public interest and therefore report them. According to the new European rules, appropriate mechanisms will have to be put in place in both public and private organizations to report irregularities and to protect whistleblowers from retaliation.The implementation of the directive into Slovenian legislation will also bring new obligations for companies. This article discusses the establishment of secure channels for reporting irregularities, standards for protecting whistleblowers from retaliation, and ways to prevent malicious reports. Establishment of an effective system for the protection of whistleblowers is becoming a mandatory part of corporate governance in Slovenia.
