A Regulatory Evidence Framework for Assessing Unauthorized Structure Violations Within Protected Airport Obstacle Limitation Surfaces

Background: The regulatory enforcement of obstacle limitation surface protection requirements at Nigerian civil aviation aerodromes is impeded by a structural gap between the technical evidence generated through aerodrome safety inspection processes and the evidentiary standards required to sustain enforcement actions through the Nigerian judicial and administrative enforcement systems. Aerodrome safety inspectors trained in ICAO Annex 14 compliance assessment methodology may not be equipped to document encroachment violations in the format and with the evidential quality required for successful prosecution of enforcement actions before the Federal High Court or state administrative enforcement bodies, resulting in technically valid enforcement cases that fail procedurally for evidentiary deficiencies that competent evidence framework guidance would have prevented Methods: This paper proposes a Regulatory Evidence Framework for unauthorized structure violations within airport obstacle limitation surfaces, integrating a four-tier evidence classification system defining minimum documentation standards for each enforcement action level, expert witness testimony protocols aligning civil aviation technical evidence with Nigerian court evidentiary standards, chain of custody procedures for physical evidence collected during aerodrome safety inspections, and a cross-jurisdictional enforcement coordination model connecting federal civil aviation authority action with state planning authority permit revocation processes and criminal law enforcement referral procedures where applicable Results: The Regulatory Evidence Framework provides a comprehensive documentation methodology that enables aerodrome safety inspectors and NCAA legal counsel to construct evidentiary records meeting the procedural and substantive standards required for successful enforcement action at each tier of the enforcement action hierarchy, from administrative notice proceedings through Federal High Court demolition orders to criminal prosecution for willful violation of aerodrome safety regulations. Application of the framework at the four international gateway aerodromes would substantially improve the proportion of enforcement cases achieving successful corrective action within the applicable compliance timelines Conclusion: The Regulatory Evidence Framework addresses the evidentiary competency gap in NCAA encroachment enforcement by providing actionable documentation guidance that translates technical aerodrome safety inspection findings into legally defensible evidence records, enabling the regulatory enforcement capacity implicit in the Civil Aviation Act and NCAA Aerodrome Standards and Certification Regulations to be more fully exercised in practice
