The clarifying role of doctrine for legal communication

Abstract

This article studies the way in which legal doctrine may contribute to the realization of a more efficient communication of law. In Romanian Law, its main sources are the law, practices and general principles of law. As such, doctrine is not acknowledged as an authentic source of law. Nevertheless, a substantial amount of both legislative solutions and jurisprudential ones were possible as a consequence of solutions proposed by law scholars, through doctrine. Thus, the role of doctrine is to facilitate communication of law and to contribute to alleviation of negative effects of defective communication.
