Origins of the general principles of law

Abstract

Principiile generale de drept sunt acele elemente fundamentale, idei cu un grad ridicat de generalitate, ce pot fi regăsite în orice sistem de drept şi care călăuzesc, pe o durată de timp relativ îndelungată, atât elaborarea, evoluţia şi interpretarea, cât şi aplicarea normelor de drept. Principiile de drept nu pot izvorî din imaginaţie sau din pure speculaţii. Principiile capătă o largă răspândire într-o societate, într-o anumită perioadă, încă înainte de a exista norme juridice care să le recunoască. De aceea, nu pot exista principii de drept imuabile, care să valoreze pentru orice timp şi orice loc. În orice sistem de drept, din orice perioadă istorică sau din orice loc, pot fi identificate principii generale. În fiecare perioadă istorică atât ştiinţa dreptului, cât şi dreptul pozitiv au fost influenţate de conceptele, ideile generale, considerate ca fiind adevărate la acea vreme.
