Theories of criminal law extra-activity

Abstract

The issue of law application in time has represented a reason to debate among theoreticians for a long period of time. The evolution of theories that have been formulated on this matter, in order to establish a functional system on the basis of which to determine the applicable law in the case of a temporal conflict of criminal laws, corresponds to the more and more accentuated influence that the principle of humanism has on criminal law regulations. From this perspective, the theoreticians’ goal is to limit the possible abuses that might appear through a chaotic enactment in the criminal law matter.
