International legal cooperation in criminal matters

Abstract

When we analyze the EU policy with respect to cooperation in criminal matters, it follows that there are two developing systems of cooperation in order to improve ways of addressing organized crime and serious criminal activity. The first finding, observed especially after the Treaty of Amsterdam, is the imposition of criminal penalties in certain offenses that are affecting the Member States. The second is the establishment of the specific institutions in order to carry-out integrated actions in addressing crime, and of the rules for closer cooperation with the judicial and prosecution authorities. All these policies, which have been developed at EU level, are necessary in order to prevent and combat international crime. Organized crime has a cross-border character and often exceeds the capacity of action of the national authorities responsible for law enforcement; that is why international cooperation is necessary, developed at tactical, operational and strategic level. It also requires a coordinated action to analyze and combat the organized crime.
