A proposito di Guido Calabresi, il futuro di Law & Economics

Abstract

I rapporti tra diritto ed economia si possono configurare in diversi modi e con diversi metodi. Guido Calabresi nelle sue ricerche che sono condensate nel libro su "Il futuro della Law and Economics" preferisce studiare il diritto tenendo conto anche, ma non solo, delle regole economiche, dell?ambiente, delle soluzioni ottenute mediante ricorso alle istituzioni pubbliche e alle politiche sociali. E quindi il suo approccio ? diverso rispetto a quello prevalentemente seguito denominato Economic Analysis of Law nel quale invece spetta all?economia il compito di misurare le regole giuridiche a seconda degli effetti positivi o negativi che esse dispiegano sul mercato, sicch?, in sostanza, il diritto dovrebbe mimare le regole economiche.
