Il recesso di pentimento nell?acquisto a distanza di prodotti o servizi finanziari

Abstract

In questo articolo si analizza la figura del recesso di pentimento, con particolare riguardo ai recessi di pentimento concessi al consumatore che acquista fuori sede o a distanza prodotti finanziari. L?Autore ne identifica le fonti (Testo Unico Finanzario e Codice del consumo), le caratteristiche generali, gli effetti e le modalit? di funzionamento, soffermandosi soprattutto sulle differenze rispetto al recesso di pentimento attribuito ai consumatori per l?acquisto fuori dai locali commerciali o a distanza. Ne deriva una figura speciale di recesso di pentimento, legata strettamente alle particolari difficolt? di comprensione dei contenuti dell?operazione economica che viene proposta al consumatore mediante tecniche di comunicazione a distanza.
