Interessi e anatocismo nei contratti bancari

Abstract

In questo articolo analizzo, brevemente, la storia ed il presente dell?anatocismo bancario. La norma consuetudinaria, che consentiva di pattuire clausole anatocistiche nei contratti bancari, ? stata "abrogata" dalla Cassazione con una sentenza con cui la Corte dimostra poca dimestichezza con la teoria del diritto. Il divieto pretorio dell?anatocismo bancario ha avuto, per?, vita breve: una norma scritta ripristina la possibilit? di convenire clausole anatocistiche nei contratti tra le banche ed i clienti. Con l?abrogazione anche di quest?ultima norma, ad opera di un recente e contraddittorio intervento legislativo, si ? creata una situazione di incertezza sull?attuale vigenza o meno, nel nostro ordinamento, di un divieto di anatocismo bancario. La soluzione che io sostengo, al termine di questa indagine, ? che nell?ordinamento italiano la produzione di interessi sugli interessi, nei contratti bancari, sia ormai vietata.
