Le asimmetrie regolamentari nell?industria dei fondi comuni aperti

Abstract

L?obiettivo di livellare il terreno competitivo tra gli operatori europei del risparmio gestito non sembra ancora pienamente raggiunto. Nei diversi paesi permangono infatti alcune residue divergenze - nelle modalit? di recepimento e di interpretazione delle normative comunitarie, nelle prassi di vigilanza, nei regimi sanzionatori, nella regolamentazione settoriale - tali da penalizzare potenzialmente gli operatori e i prodotti sottoposti alla disciplina pi? stringente. Il presente contributo si focalizza sul comparto dei fondi comuni aperti italiani e intende arricchire la letteratura sul tema passando in rassegna in ottica comparata le principali norme e prassi di vigilanza "competition sensitive" suscettibili di limitare l?attrattivit? di tali prodotti rispetto a quelli esteri commercializzati in Italia o rispetto a prodotti finanziari alternativi. Come noto, le asimmetrie regolamentari sono considerate una delle cause del declino attraversato nel passato recente dall?industria italiana dei fondi comuni d?investimento mobiliare. L?individuazione dei residui spazi di discriminazione competitiva di matrice normativa rappresenta la necessaria premessa per prefigurare un possibile percorso di ottimizzazione della regolamentazione.
