Abstract

Attuazione della direttiva sui servizi finanziari a distanza (di Guido Alpa) - ABSTRACT: Con d.lgs. 19.8.2005, n. 190 si ? data attuazione alla direttiva 2002/65/CE relativa alla commercializzazione di servizi finanziari ai consumatori. L?ambito della disciplina ? pi? ampio di quanto possa desumersi dal titolo, in quanto essa si riferisce a tutte le procedure con cui si offre al consumatore un servizio finanziario, procedure alle quali potrebbe partecipare anche un soggetto diverso dal fornitore. La direttiva, e cos? la sua disciplina di attuazione, concernono soltanto il rapporto negoziale che si istituisce tra il consumatore (investitore non professionale) e il fornitore, cio? il soggetto che viene a contatto telematico con il consumatore.
