Abstract

Il servizio pubblico tra teoria e storia (di Giuseppe Di Gaspare) - ABSTRACT: La nozione di servizio pubblico si sviluppa nello Stato liberale con riferimento a quelle attivit? economiche svolte per soddisfare, al di fuori dalla logica concorrenziale, gli interessi della collettivit?. L?assunzione in mano pubblica di tali servizi qualifica, da un lato, la forma giuridica del soggetto erogatore e, dall?altro, il regime dell?attivit?, del quale sono caratteri strutturali la sottrazione al mercato e il vincolo del pareggio di bilancio. La progressiva espansione dei servizi pubblici verso settori aperti alla concorrenza, registrata nel secondo dopoguerra, si interrompe con l?esplosione del deficit pubblico e il consolidamento del sistema giuridico europeo, che stigmatizza l?alterazione del mercato realizzata mediante ausili finanziari pubblici. Il concetto di servizio pubblico sembra recuperare, pertanto, gli originari presupposti e settori di operativit?. Giuseppe Di Gaspare ?
