Abstract

La disciplina della concorrenza e la correttezza nell?attivit? commerciale (di G. Alpa) - ABSTRACT: E? riconosciuta la libert? d?impresa, conformemente al diritto comunitario e alle legislazioni e prassi nazionali?: cos? recita l?articolo 16 della Carta dei diritti fondamentali dell?Unione europea. Avulsa dal suo contesto e letta secondo i canoni della interpretazione letterale, questa disposizione sembra legittimare qualsiasi comportamento degli operatori economici che si svolga entro questi soli limiti, limiti per cos? dire interni al mercato. Ma, come ogni disposizione normativa, anche l?art. 16 della Carta deve essere interpretato nel suo contesto, e cio? secondo i canoni della interpretazione sistematica e della interpretazione teleologica.
