Abstract

La responsabilit? delle autorit? di vigilanza e la tutela dei risparmiatori. Un raffronto tra il sistema italiano e quello inglese (di Filippo Rossi) - ABSTRACT: Il presente saggio opera un raffronto dei risultati ottenuti dalla giurisprudenza italiana e inglese in materia di responsabilit? civile delle autorit? di vigilanza (Bank of England e Consob). Tale analisi ? preceduta dallo studio dei leading case dettati dalla giurisprudenza inglese in materia di responsabilit? degli organismi di diritto pubblico (Statutory Bodies), nella convinzione che essi siano utili per comprendere i profili di politica del diritto che sconsigliano l?adozione di un modello di responsabilit? delle autorit? di vigilanza troppo vasto. Il saggio si conclude con l?esame della sentenza della Corte di Cassazione 6 marzo 2001, n. 3132 e con lo studio della pronuncia della House of Lords nel caso Three Rivers District Council and Others v. Governor and Company of the Bank of England, dedicando particolare attenzione alle disposizioni dettate dal Banking Act del 1987 e dal Financial Services and Markets Act del 2000.
