Abstract

La ripartizione del traffico aereo all'interno del sistema aeroportuale di Milano. Problemi di incompatibilit? con i principi e la normativa comunitaria in tema di accesso dei vettori aerei della Comunit? alle rotte intracomunitarie (di Rosa Abbate) - ABSTRACT: Le norme italiane sulla ripartizione del traffico aereo all?interno del sistema aeroportuale di Milano adottate con i decreti 5 luglio 1996 n. 46-T, 12 ottobre 1997 n. 57-T 3 e 3 marzo 2000 in conflitto con la normativa comunitaria dettata dal Reg. 2408/92 sull?accesso dei vettori aerei della comunit? alle rotte intracomunitarie. La decisione della Commissione Europea del 16 settembre 1998 e la successiva decisione della Corte di Giustizia in data 18 gennaio 2001 costituiscono recente esempi di applicazione del Reg. 2408/92. Dal caso "Viva Air" al "caso Malpensa". Il processo di liberalizzazione del settore del trasporto aereo si realizza attraverso l?emanazione del "terzo pacchetto" di regolamenti in attuazione del principio della libera prestazione dei servizi aerei nella Comunit?. L?applicazione del principio di proporzionalit? e del principio di non discriminazione sanciti dal Reg. 2408/92 quali parametri adottati per la risoluzione dei provvedimenti relativi alla ripartizione del traffico aereo all?interno del sistema aeroportuale milanese.
