Abstract

L?impresa pubblica locale nel diritto comunitario e nazionale (di Giuseppe Di Gaspare) - ABSTRACT: L?Autore disegna la genealogia ed il quadro evolutivo del servizio pubblico locale in Europa, evidenziando le differenze rispetto all?esperienza statunitense. Il progetto di adeguamento del mercato unico comunitario alle sfide dell?economia globale e dello sviluppo tecnologico ha condotto ad una ri-regolazione dei servizi di pubblica utilit?, in modo conforme alle norme del Trattato europeo che tutelano la concorrenza, attraverso l?elaborazione di tre nozioni fondamentali: il servizio universale, il servizio di base ed il servizio a valore aggiunto. Nelle singole realt? nazionali permangono, tuttavia, differenti modelli legislativi ed organizzativi delle imprese di gestione dei servizi locali, con un diverso grado di apertura alla concorrenza. L?Autore sottolinea che questa dinamica non sincronica nello sviluppo del mercato comune dei servizi finisce paradossalmente per pregiudicare i Paesi che introducono la competizione, sollecitando una normativa minima che armonizzi l?accesso ai mercati nazionali su base di reciprocit?.
