Abstract

Sotto il profilo giuridico, l’accesso alla proprietà della terra si pone oggi in termini molto diversi dal passato: esso è presupposto per godere dei valori ambientali che la terra esprime, è condizione di un più generale godimento della natura e del paesaggio, ma è anche espressione della consapevolezza e della responsabilità che noi abbiamo verso la terra e verso le generazioni future. La terra reclama diritti attraverso usi sostenibili, atteggiamenti responsabili, valori ideali, comportamenti solidali. È necessario pertanto un nuovo patto sociale tra l’uomo e la terra, che regoli anche i diritti di quest’ultima. È questo il compito dei giuristi, soprattutto di quelli di diritto agrario: è necessario, costruire più adeguate strumentazioni per modificare l’ordinamento in funzione di un nuovo orizzonte strategico dell’agricoltura e per assicurare la sopravvivenza dell’umanità.
