La futura disciplina delle informazioni alimentari (Prima parte)

Abstract

La proposta di regolamento sulle informazioni alimentari, presentata nel gennaio 2008, si pone l?obiettivo di semplificare e chiarire l?attuale scenario del settore dell?etichettatura degli alimenti attraverso la rifusione in un unico contesto di diversi atti normativi e la razionalizzazione, l?aggiornamento e il chiarimento delle disposizioni stabilite dalla fondamentale direttiva 2000/13. Molte sono le novit? introdotte, sia formali che sostanziali. Dopo aver analizzato il ruolo dell?informazione nei confronti della tutela del consumatore e della libera circolazione delle merci, il saggio si sofferma su un primo profilo innovativo introdotto dalla proposta concernente il rapporto tra tutela del consumatore e funzionamento del mercato unico. L?indagine rivela come, in controtendenza rispetto alla vigente legislazione (dir. 2000/13) - e alla ricca giurisprudenza della Corte di Giustizia in argomento, la proposta riconosca una maggiore attenzione alla tutela del consumatore in particolare al suo diritto all?informazione - rispetto alla libera circolazione delle merci.
