Ormanda Mülkiyet Hakları Mücadelesi Ve Orman Kanunu’nun 2/B Düzenlemesi

Abstract

Yaşamsal önemi her geçen gün artan orman ekosistemlerinin insan tahribatına karşı korunması sorununun temelinde ormanlardan faydalanmanın hukuksal düzenlemesi yatmaktadır. Türkiye’de ormandan faydalanmayı düzenleyen mevzuatın bir parçasını orman niteliğini yitirmiş arazilerin orman rejimi dışına çıkarılmasını düzenleyen Orman Kanunu’nun İkinci Madde B Bendi oluşturmaktadır. Çalışmanın amacı bu düzenlemeyi sınıflar arası ilişkilerin ve buna bağlı olarak da devletin işlevlerinin dönüşümü bağlamında, orman sayılan araziler üzerinde mülkiyet hakkı iddiasında olan çeşitli kesimlerin mücadele alanı olarak açıklamaktır. Çalışmada 2/B hükmünün ve arkasında yatan ve/veya bu hükmü hazırlayan toplumsal ilişkilerin evrimi iki dönemde, orman sayılan arazilerde bireysel mülkiyetin kurulması sürecinde mihenk taşı niteliğindeki 1937 ve 1945 tarihli yasaları izleyen yıllar ile Türkiye’de toplumsal ilişkilerin önemli ölçüde dönüştüğü 1980 sonrasındaki gelişmeler çerçevesinde ele alınmaktadır. Çalışmanın dayandığı veriyi yasa, yönetmelik, yargı kararı, sektör planları gibi hukuksal belgeler, bu mevzuata ilişkin Meclis Komisyon Raporları ve Genel Kurul Tutanakları ve ikinci el verileri içeren kamu kurum raporları, istatistik veriler gibi kaynaklar oluşturmaktadır.

    Note: [English Title] STRUGGLE FOR PROPERTY RIGHTS ON FOREST LAND AND THE SECOND ITEM OF THE FOREST LAW [English Abstract] Protection of forest ecosystems against destruction by human economic activities rests on the legal ordering of these activities. One part of the legislation ordering these activities in Turkey is the Second Item of the Forest Law which regulates exclusion from forest jurisdiction, the parcels of land that have lost their qualities as forests. The study aims to explain this modification of law as a fi eld of struggle by various groups that claim property rights in areas legally defi ned as forests. The study sets these struggles in the context of changing class relations and state transformation. The study takes up two periods, i.e. the period following two landmark laws in the constitution of individual property rights on forest land (1937 and 1945), and the post-1980 period when social relations in Turkey have undergone vast transformations. The study rests on legal documents like laws, regulations, court decisions, and sectoral plans, the Parliamentary Committee Decisions and Parliamentary Discussions, and on second hand data like state reports and statistical data.
