Los Sistemas De Protección Jurídica De Conocimientos Tradicionales

Abstract

En las últimas décadas ha habido un intenso debate sobre la protección de los conocimientos tradicionales. Es evidente que existe un desajuste entre el sistema vigente de protección de los derechos de propiedad intelectual para su aplicación a los conocimientos tradicionales, por una parte porque son prácticas que mantienen aspectos espirituales, y por otro lado, la apropiación directa o indirecta de recursos biológicos, genéticos o conocimientos tradicionales por parte de terceros. Desde la Organización Mundial de la Propiedad Industrial (OMPI) se inició en 1988 una serie de consultas, conferencias y misiones exploratorias de investigación para determinar y analizar las necesidades y aspiraciones en materia de propiedad intelectual de nuevos beneficiarios, entre otros, los titulares de conocimientos e innovaciones tradicionales. En el ámbito del folclore, en colaboración con la UNESCO, la OMPI ha trabajado desde 1978 para su adecuada protección.
