Aproximación del Derecho de Autor al Arte Performativo

Abstract

A la vista de la multiplicidad de negocios y actividades ocasionadas por la digitalización y la difusión on –line del Arte Performativo, en esta contribución se pretende desde la perspectiva del Derecho de autor clarificar y distinguir entre la obra Performativa correspondiente al autor y su representación o Performance del artista – intérprete. Se analizan los derechos morales y de explotación correspondientes a ambos grupos así como sus límites y excepciones. Por último, se ofrece una aproximación a los contratos de cesión, haciendo un especial hincapié en el contrato de representación de la obra Performativa y en los derechos de remuneración pactada y legal de los artistas – intérpretes.
