Patrimonio Fotográfico. Originalidad Y Dominio Público. Una Aproximación Desde El Derecho De Autor En España

Abstract

Como un elemento determinante de la gestión de los derechos de Propiedad Intelectual sobre el Patrimonio Fotográfico se analizan los diferentes períodos de entrada en el dominio público de las fotografías así como la incidencia de la originalidad en la duración de estos derechos. La originalidad es examinada desde la perspectiva normativa y jurisprudencial comunitaria poniendo de relieve la práctica del Tribunal Supremo español en su trasposición.
