Amnistía a grupos vulnerables en México. ¿Es una herramienta que mitigue la injusticia social?

Abstract

La amnistía es una figura jurídica que busca suspender juicios penales o dejar sin efecto las penas fincadas a quienes hayan sido condenados por sentencia definitiva. Recientemente se aprobó la Ley de Amnistía, la cual busca beneficiar a personas sentenciadas o que enfrenten un proceso penal que pertenezcan a grupos sociales vulnerables, entre quienes se encuentran las mujeres, jóvenes y personas pertenecientes a grupos indígenas. La finalidad del Ejecutivo Federal al proponer esta ley, es atender uno de los mayores reclamos de la nación: la justicia. De acuerdo con la exposición de motivos de dicha ley, se considera que existe una relación inversa entre el acceso a la justicia y la condición económica de las personas porque se ha determinado que entre menor es el nivel de ingreso económico, mayor posibilidad de que la justicia se convierta en su antítesis, en una injusticia.
