El pluriempleo y la formalización de las relaciones laborales en Cuba

Abstract

El objetivo del presente trabajo es argumentar que existe una evidente contradicción entre lo preceptuado en los reglamentos de la política de empleo, históricamente aplicados en Cuba y la restrictiva interpretación del artículo 28 de la Ley No. 116/2013 Código de Trabajo, que causa inseguridad y vulnera los derechos laborales de los trabajadores en el sector estatal cubano. Se analiza cómo se establecen diferentes tipos de relaciones laborales para igual cargo, funciones y contenidos de trabajo solo en dependencia de la escala salarial, lo cual constituye una incoherente labor legislativa, con las consecuentes afectaciones de las garantías laborales.
