El derecho de información del consumidor peruano frente a los alimentos transgénicos

Abstract

La incursión de la biotecnología en los alimentos ha generado el nacimiento de los alimentos transgénicos. Para certificar su inocuidad, los científicos sólo efectúan una equivalencia sustancial que determina su inocuidad relativa. Sin embargo, la Organización de las Naciones Unidas para la Alimentación y la Agricultura (FAO) y la Organización Mundial de la Salud (OMS) manifiestan que su consumo no ha registrado efectos sobre la salud humana. No obstante, la ausencia de estudios toxicológicos más detallados a largo plazo, ha motivado que la población desconfíe, por los probables riesgos que podría originar en temas de alergenicidad, toxicidad o de un cambio accidental en el nivel de nutrientes. Esta inquietud ha motivado que el Código de Protección y Defensa del Consumidor, establezca que los alimentos transgénicos deben ser etiquetados; pero la reglamentación del artículo pertinente continúa pendiente, por lo que aún es inaplicable. ¿Y el derecho a la información como derecho fundamental del consumidor? ¿Dónde queda su función de garantía de la adopción de decisiones mejor y más informadas a la hora de optar entre los productos que se le ofrecen en el mercado?
