El derecho a la seguridad social de los empleados domésticos en México

Abstract

En el presente trabajo de investigación, se muestra un análisis jurídico nacional y supranacional en correspondencia al derecho a la seguridad social de los empleados domésticos en México, derecho reconocido en la misma Constitución Política de los Estados Unidos Mexicanos, así como en ordenamientos internacionales, tales como la Declaración Universal de los Derechos Humanos, la Convención Americana de los Derechos Humanos, el Pacto Internacional de Derechos Económicos, Sociales y Culturales y la Organización Internacional del Trabajo. Se exhibe la inequidad ante la normativa doméstica en materia de seguridad social, al realizar distinción de los trabajadores remunerados en el hogar en relación a las demás actividades laborales. De igual forma, como sustento al estudio se utilizaron datos de la Encuesta Nacional de Ocupación y Empleo (ENOE), así como de la Consulta Dinámica del Instituto Mexicano del Seguro Social (CUBOS), mostrándose una amplia brecha en la igualdad ante la ley.
