Ausencia de tipología expresa para la configuración del delito de revelación de secreto empresarial de la persona jurídica y su debida aplicación en el COIP

Abstract

En el presente proyecto de investigación científica, se analizará el artículo 179 del Código Orgánico Integral Penal, artículo 260 de la Decisión Andina y demás normas referentes al secreto empresarial y la revelación de secreto, así como la falta de tipología expresa para la aplicación por parte de la persona jurídica la cual al poder tratarse de un secreto empresarial importante, innovador y exitoso para la misma y al cumplir éste con las características de ser considerado secreto empresarial tales como ser registrado, es decir que sea secreto y no tenga acceso al público, que por ser secreta la información tenga un valor económico, y que la persona y/o responsable que conozca de este secreto tome las medidas adecuadas para que continúe siendo secreto, el cual al ser revelado podría causar un perjuicio que puede llevar a la quiebra a la empresa y de acuerdo a lo establecido en el Código Orgánico Integral Penal no especifica la sanción a la persona jurídica, sean éstas agravantes o atenuantes.
