Sobre la Ley Minera de México: ¿dislate legislativo insustentable o llana corrupción ambiental suicida?

Abstract

El artículo plantea el problema general de la legislación mexicana y su aplicación. En lo particular plantea los problemas de la Ley Minera con los efectos que causa. Por medio del análisis crítico se estudia la ley que ordena la minería en México aprovechando lo señalado por diversos autores. Se hace un comparativo de contraste entre lo que formula la ley y las realidades mexicanas e internacionales. Se observan las afectaciones que la ley y su mala aplicación han generado en varios casos reales recientes y vigentes en el país. Se encuentra que la Ley Minera junto a otras leyes han sido promotoras de inequidad e injusticia ambiental, debido en parte a su mala elaboración y aplicación discrecional que se organiza para servir a los intereses capitalistas nacionales y extranjeros. Se detecta que esta ley ha contribuido a la acelerada pérdida de los bienes públicos para ser privatizados por medio de un proceso de despojo, y al agotamiento de los recursos mexicanos y la afectación negativa de los ecosistemas provocando mayor insustentabilidad acompañada de niveles más altos de pobreza. Se determina que las leyes mexicanas y la Ley Minera no son hechas ni destinadas para el beneficio socioambiental.
