América Latina Y La Necesidad De Fundamentación Desde Bases Jurídicas Del Proceso De Integración Regional

Abstract

El propósito fundamental del siguiente artículo es analizar algunos aspectos relacionados con el proceso de integración regional en América Latina y la necesidad de crear las bases jurídicas para la formación de un esquema que posibilite la plena unidad continental, sustentada en el Derecho. Algunos elementos, como la subregionalización o fragmentación de estos procesos y su proyección esencialmente económica, así como otros obstáculos, impiden alcanzar una adecuada fundamentación desde bases jurídicas de la integración latinoamericana, definiendo aquí el alcance e importancia de esta categoría, y su posible realización a través de la configuración de algunos modelos, como el confederal, al menos transitoriamente, en nuevos esquemas como el ALBA, para abrir paso a una integración superior.
