Abstract

El código de aguas chileno, considerado por muchos como el más liberal del mundo, ha generado polémica desde el año de su publicación (1981). De acuerdo con diversos artículos sobre gestión de recursos hídricos, una de las principales críticas se centra en que esta Ley produciría “acaparamiento” y especulación de Derechos de Aprovechamiento de Aguas, lo que impediría un adecuado funcionamiento del mercado y la reasignación óptima, que es precisamente lo que busca el modelo de gestión, plasmado jurídicamente en lo que se denomina Código de Aguas.
