Abstract

In this article, we leave of the estimated one that, in a market economy as the Brazilian, the government needs to count on two important instruments - that they interact and if they complement -, to guarantee the economic growth: the antitrust legislation and the politics of economic regulation. Thus, we have as objective, supported in the new institutional economic theory (North, 1990), to portray in general lines the politics and the Brazilian system of free market defense (SBDC), as well as evaluating the effect of the decisions of the Board of directors of CADE - with emphasis in the decisions on the analyzed acts of concentration after-1994 -, for the institutional fortify of the related system. We conclude, to end, that system of free market defense - where it weighs to the evidences of that it needs to be equipped, in terms of financial resources and human, that lack of a bigger rapidity in the appreciation of determined acts and that it needs to perfect the mechanisms of coordination of the agencies of the system -, it is if consolidating institutional in Brazil
