Ensayo Sobre El Acuerdo De Cooperación Ambiental De América Del Norte (Acaan): De Acuerdo A Su Función Y Estructuración

Abstract

El presente ensayo explica los mecanismos existentes sobre las controversias e estructuración sobre comercio y medio ambiente en el marco del TLCAN. En lo que concierne al Tratado de Libre comercio de América del Norte (TLCAN) 1, la resolución de controversias que coinciden con la protección ambiental la podemos hacer valer tanto por medio del arbitraje, como por medio del acuerdo paralelo especifico en materia ambiental que para tal efecto creo el propio Tratado de Libre comercio de América del Norte (TLCAN), y al cual conocemos como Acuerdo de Cooperación de América del Norte (ACAAN)2 , el entro en vigor paralelamente al TLCAN. La intención es determinar si los mecanismos son efectivos y ayudan a consolidar las metas del Acuerdo paralelo de Cooperación Ambiental de América del Norte (ACAAN). El análisis compara controversias comerciales presentadas mediante el proceso de peticiones ciudadanas establecido en el ACAAN, con otras resueltas ante organismos de arbitraje internacionales.
