Ley Fatca Y Sus Inicios De Aplicaciã“N En Un Mundo Globalizado

Abstract

El 18 de marzo del año 2010 el Presidente de los Estados Unidos “Obama firmó el “Hiring Incentives to Restore Employmen Act (“ HIRE Act†). Una parte de (“HIRE Act†). Contiene las normas de la Ley de FACTA. La Dirección General de Impuesto, se enfrenta ahora a un nuevo reto, y es, la cooperación con sus contrapartes extranjeras para gestionar de forma eficaz sus leyes tributarias nacionales. A partir de los escándalos bancarios del año 2008 y la crisis financiera mundial posterior, es pues, el Foro Global sobre Transparencia e Intercambio de Información Tributaria ha propiciado e incentivado el intercambio de informaciones a requerimiento como el estándar internacional en materia de transparencia fiscal. El intercambio de forma automática de información le permite a las jurisdicciones de la residencia verificar si sus contribuyentes han incluido correctamente las rentas obtenidas en el exterior, permitiéndoles a las autoridades tributarias contar con alertas tempranas de posibles casos de incumplimiento. En febrero del año 2014, la OCDE publicó su propuesta para un nuevo modelo global de intercambio automático de información aplicable a las cuentas mantenidas en entidades financieras.
