Labeling Approach: a seletividade penal segundo a estigmatização física e social do indivíduo

Abstract

A Constituição Federal, em seu artigo 5º, faz a previsão expressa acerca da isonomia de todos perante a lei, vedando quaisquer distinções, seja para brasileiros ou estrangeiros residentes no país. O tema central do artigo consiste em demonstrar que a realidade é bem diferente: a desigualdade social gera para os indivíduos os denominados estigmas, ou seja, esses mesmos indivíduos são rotulados em grande parte das vezes, inclusive para o sistema penal como suspeitos diretos da prática de delitos, mormente por sua classe econômica e social, raça, e determinadas características pessoais que geram para esses indivíduos a presunção da delinquência. Neste viés, surge a teoria denominada de Labeling Approach, ou seja, a teoria da rotulação social do indivíduo de acordo com os fatores acima citados.
