Dos direitos fundamentais ao direito processual penal

Abstract

A irradiação dos Direitos Fundamentais, individuais e sociais, causada pela evolução do Estado Liberal de Direito para o Estado de Direito Social, sempre motiva a necessidade de reforçar o ideal constitucionalista de tornar cada vez mais eficazes os direitos instituídos na Constituição Federal de (1988) do Brasil. É refletindo sobre os Direitos Fundamentais, individuais e sociais, que este artigo objetiva reforçar a importância de serem preservadas as garantias e liberdades constitucionais para uma Dignidade Humana plena, cujo dever de preservação e defesa compete ao Estado perseguir, com a aplicação de todos os seus meios e recursos principalmente sobre a área que mais avilta o indivíduo, o Processo Penal.
