Abstract

El presente artículo, titulado: “Hacia la objetivación del interés superior de la niñez y la adolescencia†, se propone analizar el interés superior en cuestión a partir de las diversas posturas teóricas que se han asumido, así como las propuestas normativas que se han dictado. Todo ello tiene como finalidad que se concrete el contenido de un concepto indeterminado, de una noción marco, para que su interpretación y consiguiente aplicación resulte ajustada a Derecho, so pena de incurrir en una abusiva discrecionalidad por parte de la autoridad pública y/o privada. Se valoran los sistemas de objetivación, a saber: cláusula general y criterios normativos preestablecidos. Finalmente, valga resaltar que no han de asumirse de forma ingenua, sino que ambos sistemas deben complementarse en pos de alcanzar ese desarrollo holístico de la personalidad de niños, niñas y adolescentes.
