A mutação inconstitucional no entendimento do STF sobre a imprescritibilidade das ações de ressarcimento

Abstract

Este artigo teve como finalidade o exame da decisão proferida pelo Supremo Tribunal Federal no Recurso Extraordinário nº 669.069/MG, sobre a extensão da imprescritibilidade das ações de ressarcimento previstas no artigo 37, §5º, da Constituição Federal de 1988. Foi usado o método dedutivo de abordagem, e a análise bibliográfica e legal, como método procedimental. Primeiramente, fez uma análise das principais características da ação regressiva e dos institutos da prescrição e decadência. Em seguida, resumiu os votos proferidos no Recurso Extraordinário nº 669.069/MG pelos ministros do STF. Após, tratou do tema da mutação constitucional decorrente da interpretação jurisdicional, perquiriu sobre os seus limites, tendo por guia o julgamento em comento. Este trabalho concluiu que a mudança de sentido atribuída ao texto do referido artigo é inconstitucional, porquanto transgrediu os limites semânticos aceitáveis de interpretação.
