Lei 12.683/2012: uma análise crítica face ao fim do rol taxativo de crimes antecedentes

Abstract

A efetividade de aplicação da nova lei de combate ao delito de Lavagem de Dinheiro é tema de vital importância diante da nova política criminal de combate ao crime em seu domínio econômico. A criminalização eficiente da lavagem de dinheiro representa uma forma de se punir mais direta e efetivamente as organizações criminosas. Este estudo busca uma visão crítica da nova lei, examinando a realidade criminal que motivou a edição do estatuto legal ora em vigor, diante do compromisso assumido pelo Brasil na Convenção Viena de 1988. São ainda objeto de consideração o conceito, fases e bem jurídico do delito de lavagem de dinheiro, além dos aspectos penais e processuais relevantes da lei, como o tipo penal e suas particularidades, sujeitos do delito, competência, entre outros. A nova norma reformula a ataque ao delito de Lavagem de Dinheiro, tornando-o legislação de terceira geração, isto é, com os tipos mais abrangentes e mais eficazes, seguindo uma linha de análise doutrinária e jurisprudencial.
