Compliance y modelos de organización y gestión del riesgo penal en América latina

Abstract

La creciente criminalidad transnacional en el contexto de los delitos económicos pone de manifiesto la necesidad de regular medidas preventivas en el seno interno de las organizaciones. En este sentido, el tratamiento legal de la responsabilidad de la persona jurídica permite la articulación de incentivos de compliance mediante el diseño y puesta en marcha de modelos de organización y gestión del riesgo penal. En este trabajo, se abordan los avances más significativos observados en el espacio latinoamericano. Sobre todo, tras la aprobación de nuevos instrumentos normativos que, sin lugar a duda, están contribuyendo a la generación de una nueva cultura ética y de respeto a la ley en el mundo empresarial.
