Abstract

O presente artigo visa demonstrar que a execução provisória da pena se justifica pelo trânsito em julgado da culpa. A partir do momento em que não cabe mais discussão acerca da culpa do réu, ela transita em julgado, razão pela qual a execução provisória da pena é possível. Para tanto, é necessário revisar o conceito da presunção de inocência enquanto necessidade do trânsito em julgado da sentença para então haver a execução da pena.
