Abstract

As relações entre empresas ou instituições e empregados são pautadas pelo princípio da alteridade previsto no art. 2º da CLT, a qual determina que o contrato de trabalho transfere a uma das partes todos os riscos a ele inerentes e sobre ele incidentes: os riscos do empreendimento empresarial e os derivados do próprio trabalho prestado, admitindo, assalariando e dirigindo a prestação pessoal do serviço.
